This waiver outlines the terms under which Healthy Lawn Solutions LLC provides services, ensuring clear expectations for our Spartanburg County clients.
Effective Date: January 01, 2026
This Liability Waiver (“Waiver”) is entered into between Healthy Lawn Solutions LLC and you (“Client,” “you,” or “your”), including any representatives for residential homes or commercial properties such as churches, HOAs, apartments, schools, and businesses in Spartanburg County. By submitting payment information via our secure payment portal, using our services (lawn care, landscaping, yard cleanups, and other), or receiving an estimate, you agree to this Waiver. If you do not agree, please do not use our services. This Waiver is governed by South Carolina law, and any disputes shall be resolved in Spartanburg County courts.
1. Assumption of Risk
You acknowledge that lawn care, landscaping, or any other provided services involve inherent risks, including but not limited to equipment use (mowers, trimmers), environmental factors (rocks in grass, hidden objects), and minor imperfections (e.g., small pieces of grass, weeds, or leaves not fully removed). You assume all risks associated with these services, whether known or unknown, and agree that Healthy Lawn Solutions LLC is not responsible for any resulting issues.
2. Release and Waiver of Liability
To the fullest extent permitted by law, you release, waive, discharge, and hold harmless Healthy Lawn Solutions LLC, its owners, employees, contractors, and agents from any and all liability, claims, demands, actions, or causes of action for any loss, damage, injury, or death to persons (including you, family members, employees, students, or pets) or property (including windows, doors, sprinklers, pipes, wires, cars, vehicles, or other items), whether caused by negligence, accident, or otherwise, arising from or related to our services. This includes, but is not limited to:
Damages from rocks or debris propelled by mowers, trimmers, or other equipment.
Damages to hidden or exposed sprinklers, pipes, wires, or underground utilities.
Damages to vehicles, windows, doors, or other property structures.
Injuries to people or pets during service performance.
Minor imperfections in work, such as residual grass clippings, weeds, or leaves.
You expressly waive your right to sue Healthy Lawn Solutions LLC for any such claims, except as ordered by a court of competent jurisdiction. This waiver applies to all services, including lawn care (mowing, edging, trimming, debris cleanup, blowing), landscaping (spring cleanouts, bed planning, mulching, and tree/shrub trimming), and yard cleanups (weed-picking, grass cutting, fence line trimming, pruning). I also provide Soft Pressure Wash Services, IT / Computer Diagnostics, Drywall Repair, Home Interior Painting, and Surveillance Camera Installation.
3. Client Responsibilities
To minimize risks, you agree to:
Remove all vehicles from the service site, driveway, and adjacent areas prior to service appointment. Healthy Lawn Solutions LLC is not liable for any vehicle damage.
Mark or disclose hidden hazards such as sprinklers, pipes, wires, or underground utilities. Healthy Lawn Solutions LLC is not responsible for damage to unmarked items.
Ensure people and pets are kept away from the service area during operations. Healthy Lawn Solutions LLC is not liable for injuries to people or pets.
Provide accurate property information during the free in-person estimate to avoid scope changes.
Remove dog poop from the yard prior to service. Lawn services can be suspended over unsanitary conditions, so please be respectful.
Ensure all water hoses are put away and sprinkler heads are pushed down.
Balls, bikes, small children's toys, and pet items must be picked up prior to service day.
* Failure to comply does not impose liability on Healthy Lawn Solutions LLC and services may be postponed or denied if responsibilities are not met.
4. Photo and Video Usage
By adding payment information or using our services, you grant Healthy Lawn Solutions LLC permission to take and use photos or videos of completed work for marketing, social media, and promotional purposes. No personal identifying information will be included without your explicit consent.
5. Indemnification
You agree to indemnify, defend, and hold harmless Healthy Lawn Solutions LLC from any claims, losses, damages, liabilities, or expenses (including attorney's fees) arising from your use of our services, violation of this Waiver, or any third-party claims related to your property, including those from HOAs, schools, churches, and businesses.
6. Insurance and Coverage
Healthy Lawn Solutions LLC maintains $1,000,000 in commercial and liability insurance for our operations. However, this Waiver limits our liability as stated, and you are encouraged to maintain your own property insurance for additional protection, especially commercial properties like churches, schools, and HOAs.
7. Force Majeure
Healthy Lawn Solutions LLC is not liable for delays or failures in performance caused by events beyond our control, including weather conditions, natural disasters, or governmental restrictions, which may affect service delivery for residential or commercial clients.
8. Severability
If any provision of this Waiver is held invalid or unenforceable by a court, the remaining provisions remain in full force and effect.
9. Changes to This Waiver
We hold the right to amend and update this Waiver, with changes posted on our website, as needed. Continued use of our services constitutes acceptance of the updated Waiver.
